Criminal Law (Offences against the Person) January 2002 a) Discuss Alice's criminal liability in connection with the incidents involving Briony and Chris. Alice could be found criminal liable for causing Assault Occasioning Actual Bodily Harm under section 47 of the Offences Against the Persons Act 1861 to Briony. Actus reus of ABH is when the defendant causes an assault or battery and in doing this causing actual harm or injury as seen in R v Chanfook 1994, it was held that the injuries does not need to be so permanent but not so minor, and it could be psychological harm if clinically diagnosed. Alice had the Actus reus of ABH when she warned Briony to be on her guard from now on, and when she taped a razor blade into the letter and from her actions Briony became very anxious about her safety. Mens rea of ABH is intention or recklessness but...
