In order to consider the criminal liability of Alan, Basil, Conrad, Donald and Evelyn, it is vital that we examine the behaviour of each individual separately. The issues concerned within this case link to the offences committed, in relation to the actus reus, mens rea and any other necessary defences. Before we do this we need to look at the involvement of each character in the planning of the offence and whether a charge of conspiracy is committed. In relation to the first issue, there is evidence to show that the two individuals Alan and Basil were involved in discussing an illegal offence of 'spraying the local offices of the Department of Food and Rural Affairs with slurry from Alan's pigs', however the offence of conspiracy can only be committed if there is an agreement by two or more persons to do an unlawful act'.
